1. Acceptance of Terms
By downloading, installing, or using sms2email ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Authorized Use Only
⚠️ Important: This App may ONLY be installed on mobile devices that YOU own or have explicit authorization to monitor.
Permitted Uses:
- Your own personal phones (primary, secondary, travel phones)
- Business phones you are authorized to manage
- Phones belonging to your minor children (with appropriate disclosure)
- Devices where you have documented, explicit consent from the owner
3. Prohibited Uses
🚫 The following uses are strictly prohibited and may be illegal:
- Installing on a device without the owner's knowledge or consent
- Monitoring a spouse, partner, or family member without consent
- Surveillance of employees without proper legal disclosure
- Any form of stalking or harassment
- Intercepting communications in violation of wiretapping laws
- Any use that violates local, state, federal, or international law
4. Legal Compliance
You are solely responsible for:
- Ensuring your use complies with all applicable laws in your jurisdiction
- Understanding that unauthorized interception of communications may violate federal laws (such as the Electronic Communications Privacy Act in the US) and similar laws in other countries
- Obtaining any necessary consents before monitoring any device
5. Indemnification
You agree to indemnify, defend, and hold harmless the developer of sms2email from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the App, including but not limited to any violation of these Terms or applicable laws.
This indemnification obligation survives termination of these Terms and your use of the App.
6. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of forwarded messages
- Uninterrupted or error-free operation
- Compatibility with all devices or carriers
7. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, or business opportunities
- Any damages arising from unauthorized or illegal use of the App
- Any legal consequences resulting from your use of the App
8. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
9. Subscription and Billing
Auto-Renewal
Your subscription automatically renews at the end of each billing period (monthly) unless you cancel before the renewal date. By subscribing, you authorize recurring charges to your payment method on file with Google Play.
Payment Processing
All payments are processed exclusively through Google Play. SMS2Email does not collect, store, or process any payment information directly. All billing inquiries, refund requests, and payment disputes must be directed to Google Play.
Cancellation
You may cancel your subscription at any time through:
- Google Play Store → Menu → Subscriptions → SMS2Email → Cancel
- Google Play website: play.google.com/store/account/subscriptions
Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused portions.
Free Trial
If you begin with a free trial, you will not be charged until the trial period ends. If you do not cancel before the trial expires, your subscription will automatically convert to a paid subscription.
10. Dispute Resolution and Binding Arbitration
⚠️ Important: By using this App, you agree to resolve disputes through binding arbitration rather than in court, and you waive your right to a jury trial and to participate in a class action.
Informal Resolution First
Before initiating formal dispute resolution, you agree to contact us at support@text2box.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days.
Binding Arbitration
If we cannot resolve a dispute informally, any dispute shall be resolved exclusively through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitration shall take place in California, USA, or remotely.
Class Action Waiver
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to support@text2box.com within 30 days of first accepting these Terms.
11. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms.
12. Technical Limitations
You acknowledge that:
- The App can only forward traditional SMS messages, not RCS or iMessage
- Message delivery depends on network connectivity and email service availability
- Some messages may be delayed or fail to forward due to technical limitations
13. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
